1. Who we are

1.1. These Terms of Use (the “Terms”) govern access to and use of the KidMind online platform (the “Site”), including kidmind.xyz / kidmind.ru and any related pages, applications and services we operate.

1.2. The Site is operated by Aleksey Evgenyevich Chekunin, a self-employed individual (professional income tax / NPD payer) registered in the Russian Federation, TIN 774332566739 (the “Operator”). KidMind is not a company, partnership, or establishment in the United States, the European Union, or any other country.

1.3. KidMind is an educational product: interactive stories and exercises that help children ages 5–10 notice, name and work through emotions. It is not psychotherapy, medical care, diagnosis, or counselling, and it does not replace a child psychologist or other professional.

2. Agreement

2.1. By creating an account, signing in, joining the waitlist, or otherwise using the Site, you confirm that you have read these Terms and the Privacy Policy and that you agree to them. If you do not agree, do not use the Site.

2.2. Paid access is also governed by the Subscription Terms. If there is a conflict about payment, refunds or the subscription period, the Subscription Terms apply.

2.3. These Terms are written for users of the English-language Site. They are not a translation of a Russian public offer, and they do not create an establishment, office or consumer-facing entity outside the Russian Federation.

3. Who may use KidMind

3.1. The contracting user is an adult (18 years or older) acting as a parent or legal guardian. You represent that you have legal capacity to enter into these Terms.

3.2. A child may use the educational materials only under your account and under your supervision. The account belongs to you, not to the child.

3.3. We do not knowingly create accounts for children. If you believe a child has submitted personal information to us directly, write to alexey.chekunin@gmail.com and we will delete it where we can.

3.4. You are responsible for how your child uses the Site through your account, including messages sent in conversations with the characters.

3.5. We may refuse, suspend or stop providing the Site in a country or to a person where we cannot lawfully do so, or where doing so would expose the Operator to a legal or payment-processing risk.

4. Account and access

4.1. Access may require registration with an email address and/or a Telegram account. You must provide accurate information and keep it up to date.

4.2. You are responsible for keeping your login details and Telegram access confidential. Sharing the account with anyone other than your child, for that child’s use, is not allowed.

4.3. Some levels are free. Further levels are available under the Subscription Terms. Free access does not include every feature, and we may change what is free.

4.4. We may suspend or close an account that violates these Terms, is used fraudulently, or creates a safety risk for children or other users.

5. Acceptable use

5.1. You agree to use the Site only for personal, non-commercial educational use by your family.

5.2. You must not:

  • copy, scrape, republish or sell the stories, exercises, characters, software or other materials;
  • attempt to reverse-engineer the Site or bypass access, payment or safety limits;
  • use the Site to generate or request harmful, sexual, violent or otherwise inappropriate content involving children;
  • interfere with the Site’s operation or other users’ access;
  • use the Site in any way that is unlawful in your country or in the Russian Federation.

6. Intellectual property

6.1. The Site, the KidMind name and mark, the characters (including Anna and Robbie), texts, illustrations, software and other materials are owned by the Operator or licensed to the Operator. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use them on the Site for the purposes described here.

6.2. Nothing in these Terms transfers ownership to you. You may not use our names or characters to suggest a partnership, endorsement or official app store listing that does not exist.

7. Artificial intelligence features

7.1. Conversations with Anna, Robbie and similar characters are generated in part by a language model following a script. They are not a human teacher, therapist or doctor. They can be incomplete, inconsistent or wrong.

7.2. The Site does not diagnose conditions, prescribe treatment, or handle emergencies. If your child is in danger, or you are worried about anxiety, self-harm, or serious distress, contact a qualified professional or local emergency services.

7.3. Message length and, in some cases, the number of messages may be limited. We may filter or stop a conversation for safety or technical reasons.

7.4. We do not guarantee any particular educational, emotional or behavioural result.

8. Availability

8.1. The Site is provided “as is” and “as available”. We do not promise uninterrupted, error-free or fully secure operation. We may pause the Site for maintenance, incidents, or legal reasons.

8.2. We are not responsible for problems caused by your device, internet connection, app-store rules, Telegram, a payment provider, or other services we do not control.

9. Limitation of liability

9.1. To the maximum extent permitted by applicable law, the Operator is not liable for indirect, incidental, special, consequential or punitive damages; loss of data, profit or opportunity; or damages arising from your or your child’s use of, or inability to use, the Site.

9.2. Where liability cannot be excluded, the Operator’s total liability arising out of the Site is limited to the amount you paid to the Operator for KidMind in the 12 months before the claim, or, if you have not paid, to USD 50.

9.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the mandatory law of your country of residence — including, where that law so requires, liability for intent, gross negligence, or death or personal injury caused by negligence.

9.4. You remain responsible for decisions you make about your child’s wellbeing. KidMind is a learning tool, not a substitute for parental judgment or professional care.

10. Changes

10.1. We may update these Terms by publishing a new version on the Site. The “Last updated” date will change. The new version applies from publication, unless a later date is stated.

10.2. If you do not agree to a change, stop using the Site. Continued use after the change takes effect is acceptance of the new Terms, except where mandatory law requires a different process.

11. Governing law and disputes

11.1. These Terms and any dispute arising from them are governed by the law of the Russian Federation, without regard to conflict-of-law rules that would point to another law.

11.2. If you are a consumer, mandatory protections of the country where you live may still apply and, where those rules so require, you may bring a claim in the courts of that country. We do not waive those mandatory rights.

11.3. Subject to clause 11.2, disputes are submitted to the courts at the Operator’s place of residence in the Russian Federation.
